2. Purpose: These Terms and Conditions regulate the contractual relationship between EXINIAC and the customer (consumer or non-consumer) regarding the purchase and sale of products through the website www.exiniac.com

By placing an order, the customer declares to have read, understood, and fully accepted these Terms.

3. Products and availability

  • All products presented on the website are subject to available stock.

  • EXINIAC reserves the right to change, suspend, or discontinue products without prior notice.

  • Images and descriptions are illustrative and may not exactly match the delivered product (natural variations in color, texture, or shape are possible in spices).

 

4. Prices and payment

  • The indicated prices include VAT at the current legal rate (23% in mainland Portugal).

  • Shipping costs are calculated at checkout and may vary depending on destination and weight.

  • Accepted payment methods: MB WAY, credit/debit card (Visa, Mastercard), Multibanco reference, PayPal.

  • The order is only confirmed after payment validation.

 

5. Order and confirmation

  • The order is a purchase request. EXINIAC confirms (or declines) the order by email within 3 business days.

  • The sales contract is only considered concluded after the order confirmation is sent.

 

6. Delivery

  • We ship to mainland Portugal, Madeira, Azores, peninsular Spain, and the rest of the EU. International shipping outside the EU upon quotation.

  • Estimated delivery time: 1–3 business days (mainland), 2–7 days (islands and EU).

  • Delivery is considered complete when the product is delivered to the indicated address or collected at the pickup point.

  • EXINIAC is not responsible for delays caused by carriers or incorrect addresses.

 

7. Right of free resolution (14 days) The consumer has the right to withdraw from the contract without giving any reason within 14 days from the date of receipt of the order (Decree-Law no. 24/2014). Important exceptions: For reasons of hygiene and food safety, we do not accept returns of opened products (spice jars, mixes, etc.). Only sealed and unopened products can be returned. The customer must notify their intention to withdraw by email or form. They then have another 14 days to return the goods. Return costs are the responsibility of the customer, unless otherwise agreed.

 

8. Legal guarantee of conformity Products are covered by a 2-year legal guarantee (Article 5 of DL 67/2003 and DL 84/2021). In case of defect or non-conformity, contact us within 2 months of detecting the problem. We will repair, replace, or refund as appropriate.

9. Liability: EXINIAC is not liable for indirect damages, loss of profit, or improper use of products. Liability is limited to the order value.

10. Intellectual property: All content on the website (texts, images, logo, design) is the property of EXINIAC or its licensees. Reproduction without authorization is prohibited.

11. Applicable law and dispute resolution These Terms are governed by Portuguese law. In case of dispute, the customer may resort to the competent Consumer Conflict Arbitration Center (e.g., CNIACC – www.arbitragemdeconsumo.org) or to the consumer's domicile court.

12. Changes to the Terms. We reserve the right to change these Terms. Changes will be published on the website and apply to future orders.
